We are approaching 16 weeks since the COVID-19 pandemic was declared in Canada. Under BC provincial employment standards layoffs can last up to 13 weeks (recently amended to 16 for COVID) and that time may almost be up for your laid off employees.
If employees are not recalled after 16 weeks of layoff, the layoff automatically becomes a termination, possibly resulting in severance needing to be paid within 48 hours. Outside of BC, many provinces have similar legislation.
